Terms of Service — withyou

These Terms of Service ("Terms") are an agreement between you and Observing Clouds ("we," "us," "our") governing your use of the withyou app ("the app"). By creating an account or using the app, you agree to these Terms. If you do not agree, please do not use the app.

1. What withyou is — and what it is not
withyou is a self-help support tool for people living with Relationship OCD (ROCD). It offers journaling, values and exposure exercises, reflections, and conversations with an AI companion ("The Spiral") informed by principles from Exposure and Response Prevention (ERP) and Acceptance and Commitment Therapy (ACT).
withyou is not a medical device, not a medical or mental-health treatment, and not a substitute for professional care. It does not diagnose, treat, or cure any condition. The Spiral is an AI companion, not a therapist, doctor, or licensed professional, and its responses are not medical advice.
If you are in crisis or may be in danger, the app is not the right tool. Please contact your local emergency services or a crisis line. The app provides crisis resources, which are always available to you, including before you sign in.
You are responsible for your own decisions and wellbeing. Always seek the advice of a qualified professional for questions about your health.
2. Who can use withyou
You must be at least 18 years old to use withyou. By using the app, you confirm that you are 18 or older.
3. Your account
To use most features you create an account (with email, Apple, or Google). You agree to provide accurate information, to keep your login secure, and to be responsible for activity under your account. Let us know at jason@observingclouds.com if you believe your account has been used without your permission.
4. Subscriptions, free trial, and payment
withyou offers optional paid subscriptions that unlock additional features. Core safety features, sign-in, and intake are always free.
- Free trial: We offer a 7-day free trial on our subscription plans. You will not be charged during the trial. If you do not cancel before the trial ends, the subscription begins and you will be charged for the plan you selected.
- Billing: Subscriptions are billed through your Apple App Store account. Prices are shown in the app before you purchase.
- Auto-renewal: Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before the period ends. Your Apple account is charged for renewal within 24 hours before the period ends.
- Managing and cancelling: You manage, cancel, or change your subscription through your Apple App Store account settings. The app provides a link to do this.
- Refunds: Purchases are handled by Apple, and refunds are subject to Apple's policies. We generally cannot issue refunds directly. This does not affect any statutory rights you have, including any right of withdrawal for digital services under EU consumer law, which Apple's purchase flow addresses.

5. Acceptable use
Please use withyou for its intended purpose. You agree not to:
- use the app for anything unlawful, or to harm yourself or others;
- attempt to break, disrupt, reverse-engineer, or gain unauthorized access to the app or its systems;
- misuse The Spiral to try to produce harmful content or to circumvent its safety features;
- resell or commercially exploit the app without our permission.
We may suspend or close accounts that misuse the app.
6. Your content
The content you create in the app (journal entries, values, exposures, conversations, and so on) belongs to you. You grant us the limited permission needed to store and process it in order to provide the app to you, as described in our Privacy Policy. We do not claim ownership of your personal content.
7. The app is provided "as is"
We work hard to make withyou helpful and reliable, but we provide it "as is" and "as available," without warranties of any kind, to the fullest extent permitted by law. We do not guarantee that the app will be uninterrupted, error-free, or that it will produce any particular result or improvement. The Spiral is AI-generated and may sometimes be inaccurate or imperfect; use your own judgment and seek professional help when needed.
If you are a consumer in the EU, nothing in this section limits your statutory rights to a service that conforms to the contract under EU and Dutch consumer law.
8. Limitation of liability
To the fullest extent permitted by law:
- No indirect damages. We are not liable for indirect, incidental, or consequential damages, or for loss of data caused by circumstances outside our reasonable control, arising from your use of the app.
- Cap on direct damages. Our total combined liability for all claims arising in any 12-month period is limited to the greater of (a) the amounts you paid us for the app in the 12 months before the event giving rise to the claim, or (b) €50.
- Carve-outs. Nothing in these Terms limits or excludes our liability for: (a) damage caused by our intent or deliberate recklessness (opzet of bewuste roekeloosheid); (b) death or personal injury caused by our fault; or (c) any other liability that cannot be limited or excluded under applicable law.
- Your statutory rights. Nothing in these Terms limits any rights you have that cannot be limited by law, including your rights as a consumer.
9. Changes to the app or these Terms
We may update, change, or discontinue features of the app, and we may update these Terms from time to time.
- Material changes: if we make a material change to these Terms, we will notify you in the app (and, where appropriate, by email) at least 30 days before the change takes effect. If you do not agree with a material change, you may stop using the app and delete your account before the change takes effect, and, if the change materially reduces a paid feature, cancel your subscription through your Apple account settings. If you continue to use the app after the change takes effect, the updated Terms apply.
- Non-material changes (such as clarifications or corrections) take effect when posted.
- We will not use changes to these Terms to retroactively reduce rights you had under the version in force when a dispute arose.
10. Ending your use
You can stop using withyou and delete your account at any time in the app's settings. We may suspend or end your access if you breach these Terms; where reasonable, we will warn you first and give you the opportunity to export your data.
11. Governing law
These Terms are governed by the laws of the Netherlands, without affecting any mandatory consumer protections you are entitled to where you live. If you are a consumer in the EU, you may also bring proceedings in the courts of your own country of residence.
